A diagnosed paraphilic disorder such as somnophilia does not warrant moderation of general deterrence under Verdins principle 3 where the offender was fully aware of the wrongfulness of their conduct, moral culpability is undiminished, and the offending was cold, calculated and repetitive; moreover, any moderation of general deterrence in such circumstances would be offset by increased weight on community protection and specific deterrence.
