The Court imposed a total effective sentence of one year, 11 months and 28 days for five offences (robbery, dangerous driving, taking a motor vehicle, damage to property, and minor theft), partially suspended after approximately two and a half months served, upon the offender entering a good behaviour order. The Court held that despite the prosecution's submission that further full-time custody was warranted, the offender's Bugmy factors, neurological issues from a head injury sustained in custody, and the allocation of pre-sentence custody to other Magistrates Court matters meant a partially suspended sentence without further imprisonment was the appropriate outcome. The breach of a prior suspended sentence for affray was dealt with by remaking the Magistrates Court resentencing order in the same terms.
