The Court sentenced an Aboriginal woman to suspended terms of imprisonment for aggravated threat to kill and contravening a family violence order, with sentences wholly suspended upon entering good behaviour undertakings after crediting 11 days served on remand. Taylor J held that the offender's disadvantaged childhood, exposure to domestic violence, adjustment disorder, and experience as a victim of violence from the complainant reduced her moral culpability, and that her strong rehabilitation prospects, engagement with support services, and sole care of four young children warranted suspension rather than full-time custody. A 25 per cent discount for the guilty plea was applied, reflecting both its utilitarian value and the offender's earlier attempts to resolve the matter.
