The Court gave judicial advice under s 63 of the Trustee Act 1925 (NSW) that the executors of the estate would be justified in not accepting a settlement offer made by an eligible claimant in family provision proceedings and in continuing to defend the claim. The advice was qualified so that it applies only until any further offer of substantially different effect is made, at which point the executors must consider that offer on its merits.
