The Court advised under s 63 of the Trustee Act 1925 (NSW) that an independent administrator of a deceased estate was justified in seeking expert advice on Portuguese succession law where the size and distribution of the NSW estate depended on the outcome of Portuguese proceedings, and was justified in engaging a costs assessor to determine a former administrator's entitlement to indemnification for legal costs from the estate. The Court confirmed the administrator's costs should be paid from the estate on an indemnity basis, consistent with the usual approach in judicial advice applications.
