Where a medical panel has expressed strong and unequivocal views going beyond the scope of the referred questions, and has done so without the benefit of significant omitted material, remittal to a differently constituted panel is appropriate because the appearance of unfairness outweighs any efficiency gains from remitting to the same panel.
