Text messages or other communications that demonstrate a third party's awareness of potentially irregular dealings between a solicitor and police or media may establish sufficient legitimate forensic purpose to support a production order under s 317 of the Criminal Procedure Act 2009 (Vic), even where the third party does not feature in the grounds of appeal.
