The fact that a non-party has previously searched for and been unable to locate documents responsive to a production order does not constitute a separate ground for refusing a further order under s 317 of the Criminal Procedure Act 2009 (Vic); the test remains whether production is in the interests of justice, assessed by reference to legitimate forensic purpose.
