25A Supervision condition when offence committed as young person
This section applies if—
a condition is imposed on the grant of bail to an accused person under section 25 (4) (e); and
the accused person is at least 18 years old but less than 21 years old; and
the accused person was under 18 years old when the offence to which the grant of bail relates was committed.
The director‑general responsible for this Act and the director‑general responsible for the Children and Young People Act 2008 must decide which of them is to be the responsible director‑general for matters relating to the supervision of the accused person.
If the responsible director‑general for matters relating to the supervision of an accused person is the director‑general responsible for the Children and Young People Act 2008, the accused person must be supervised as a person under 18 years old.
If the responsible director‑general for matters relating to the supervision of an accused person is the director‑general responsible for this Act, the accused person must be supervised as an adult.
