Biosecurity Act 2023

This section applies if a biosecurity auditor becomes aware of, or suspects, any of the following during a biosecurity audit:

that the authorisation‑holder has failed to comply with this Act and that failure has resulted in a critical non‑compliance prescribed by regulation;

that a person is in possession of biosecurity matter in contravention of this Act;

that a biosecurity event has happened, is happening, or is likely to happen;

that a biosecurity certificate has been issued that is false or misleading in a material particular;

that an event prescribed by regulation has happened, is happening, or is likely to happen.

The biosecurity auditor must report the matter to the director‑general—

orally, as soon as possible, but not later than 24 hours after the auditor becomes aware of the matter; and

in writing, not more than 5 days after the day the auditor becomes aware of the matter.
