Duty to notify presence of notifiable biosecurity matter—self‑incrimination

(1)

A person is not excused from complying with the duty to notify the presence of notifiable biosecurity matter under section 30 on the ground that doing so may tend to incriminate the person or expose the person to a penalty.

(2)

However, any information, document or thing obtained, directly or indirectly, because of the person complying with the duty is not admissible in evidence against the person in a civil or criminal proceeding, other than a proceeding for an offence—

(a)

against section 31; or

(b)

arising out of the false or misleading nature of the information, document or thing.
