38 End of statutory warranties—Act, s 88 (4)
The period for the end of a warranty is—
for residential building work in relation to a structural element of a building—6 years after the completion day for the work; or
for residential building work in relation to a non-structural element of a building—2 years after the completion day for the work.
In this section:
non-structural element, of a building, means a component of the building that is not a structural element.
structural element, of a building, means—
a load-bearing component of the building (whether internal or external) that is essential to the stability of the building or part of it; or
a component (including weatherproofing) forming part of the external walls or roof of the building.
