35 Functions of body corporate
A body corporate has the functions given to it by the body corporate’s constituent documents that form part of the registered scheme.
A body corporate may establish and operate a business on the common property or, with the owner’s agreement, on a lot in the scheme that is not common property, if—
the business—
is conducted according to law; and
is related to use and enjoyment of the common property, and lots in the scheme that are not common property, by owners or occupiers of lots in the scheme; and
is not conducted outside the scheme land; and
does not prevent the reasonable use and enjoyment of the scheme land by the owners or occupiers of lots in the scheme; and
separate records of the business are kept.
