230 Removing parties
The court may order that a person be removed as a party to a proceeding if the person—
has been inappropriately or unnecessarily included as a party; or
has stopped being an appropriate or necessary party.
The court may make an order under this rule—
at any stage of the proceeding; and
on application by a party to the proceeding or on its own initiative; and
whether the person to be removed is a plaintiff or defendant.
Pt 6.2 (Applications in proceedings) applies to an application for an order under this rule.
Rule 6901 (Orders may be made on conditions) provides that the court may make an order under these rules on any conditions it considers appropriate.
