33 When originating claim must be used
(1)
A proceeding must be started by originating claim if a territory law requires the proceeding to be started by originating claim.
Note
A territory law includes these rules (see Legislation Act, s 98).
(2)
A proceeding must also be started by originating claim unless a territory law requires or allows the proceeding to be started by originating application.
