3621 Form of application
An application for a costs assessment must be made by originating application.
See approved form 3.47 (Originating application for assessment of legal costs) AF2026-41.
The application must be supported by—
if the legal costs are subject to a costs agreement—a copy of the agreement; and
if the legal costs are subject to a retainer—a copy of the retainer; and
if the application is made under the Legal Profession Act, section 296—
an affidavit by the applicant stating the matters set out in that Act, section 300 (2); and
a sufficient description of the work to which the legal costs relate to enable the legal costs to be assessed.
