3923 Arbitration—employer not respondent in certain applications by dependant or personal representative
(1)
This rule applies if—
(a)
a dependant, or the personal representative, of a deceased worker asks that a claim be decided by arbitration; and
(b)
the amount of compensation payable to the dependants of the deceased worker is not an issue in the arbitration.
(2)
The employer is not a respondent in the arbitration if the employer has paid the amount of compensation—
(a)
to the applicant; or
(b)
into court to be dealt with as the court directs.
