449 Pleadings—confession of defence
(1)
If a defendant alleges a defence that arose after the proceeding was started, the plaintiff may file and serve a confession of defence.

(2)
On filing and serving a confession of defence, the plaintiff may obtain a judgment for costs to be assessed up to the day the defence was served on the plaintiff, unless the court otherwise orders.
(3)
In this rule:
defendant includes a defendant to a counterclaim.
