5410 Appeals to Court of Appeal—notice of intention to respond
A respondent to the appeal must file in the court a notice of intention to respond in accordance with division 2.3.1 (Notice of intention to respond and defence—general) as if—
the notice of appeal were an originating application; and
the respondent were a defendant; and
the appellant were the plaintiff; and
any other necessary changes were made.
However, this rule does not apply to a respondent if the respondent filed a notice of intention to respond under rule 5315 (Appeals to Court of Appeal—response to application for leave to appeal) or rule 5335 (Appeals to Court of Appeal—notice of intention to respond to application for leave to appeal out of time) in the proceeding, and the information provided in the notice has not changed.
