6350 Time—certain days excluded in working out
This rule applies if, under these rules or an order of the court, something must or may be done within a particular period of time.
If the period is 5 days or less, any day when the registry is closed is excluded in working out when the thing must or may be done.
Example
An application must be served at least 2 days before the return date for the application under rule 6008 (Application in proceeding—filing and service). If the return date is a Monday, the weekend before the return date is excluded in working out the 2-day period, and the application must be served no later than Wednesday before the return date.
Any day in the period beginning on 25 December and ending on 1 January is excluded in working out when the thing must or may be, or is, done.
