6421 Service by filing
This rule—
applies if a defendant—
has not filed in the court a notice of intention to respond or defence; or
has not given an address for service; and
does not apply to a document that must be served personally.
This rule does not apply to a criminal proceeding (see r 4006 (Criminal proceedings—application of pt 6.8) and see also r 4007 (Criminal proceedings—service on accused person by filing if no address for service)).
A document may be served on the defendant by—
filing it in the court; and
sending a sealed or stamped copy by prepaid post, addressed to the defendant, at the defendant’s last-known address.
A document filed under this rule must state on its first page that it is filed under this rule.
