73 Defendant taken to be served by filing notice of intention to respond or defence
(1)
This rule applies to a defendant in a proceeding if the defendant has not been served with the originating process for the proceeding, but files a notice of intention to respond (other than a conditional notice of intention to respond) or a defence.
(2)
The defendant is taken to have been served with the originating process on the day the defendant files the notice of intention to respond or defence.
