48 Offences—marking packaging
(1)
A person commits an offence if—
(a)
the person applies marking mentioned in the ADG code, part 6 on packaging; and
(b)
the packaging is not of a design approved under section 50 (Approvals—packaging designs).
Maximum penalty: 40 penalty units.
(2)
A person commits an offence if—
(a)
the person applies marking mentioned in the ADG code, part 6 on packaging; and
(b)
the marking is not appropriate for the packaging.
Maximum penalty: 40 penalty units.
(3)
An offence against this section is a strict liability offence.
