60 Offence—pack dangerous goods—unsuitable general packaging or goods not packed properly
A person commits an offence if—
(a)
the person packs dangerous goods for transport in general packaging; and
(b)
either—
(i)
the packaging is unsuitable for the transport of the goods; or
(ii)
the way the person packs the goods does not comply with the ADG code, part 4; and
(c)
the person knows, or ought reasonably to know, that—
(i)
the packaging is unsuitable for the transport of the goods; or
(ii)
the way the person packs the goods does not comply with the ADG code, part 4.
Maximum penalty: 40 penalty units.
