Electoral Act 1992

This section applies if—

a person attends before an officer at a polling place on polling day for an election; and

the person claims to vote at the election; and

the officer is satisfied that the preliminary certified list of electors for an electorate—

includes the claimant’s name; and

states an address for the claimant or indicates that the claimant’s address is suppressed; and

has not been marked so as to indicate that a ballot paper has already been issued to the claimant.

The officer must—

issue a ballot paper to the person for the electorate; and

record the issue on the certified list of electors.

Despite subsection (2), an officer shall not issue a ballot paper to a person who indicates that they have already voted at the election.
