Electoral Act 1992

This section applies to electoral expenditure in relation to an election that is incurred by or on behalf of a party grouping in the capped expenditure period for the election.

The electoral expenditure must not exceed the expenditure cap for the election multiplied by the sum of, for each electorate, the lesser of—

5; and

the number of candidates for the party for election in the electorate.

If the electoral expenditure exceeds the amount allowed under subsection (2), the party grouping is liable to pay a penalty to the Territory equal to twice the amount by which the electoral expenditure exceeds the amount allowed under subsection (2).

The commissioner may recover an amount payable under subsection (3) from the party.
