33 Reporting by occupiers and electrical contractors
An occupier of premises commits an offence if—
a serious electrical accident happens at the premises; and
the occupier fails to tell the relevant distributor about the accident, by telephone, immediately after the occupier becomes aware of the accident.
Maximum penalty: 50 penalty units.
An electrical contractor commits an offence if—
a serious electrical accident happens in, or in relation to, an electrical installation on which the contractor is carrying out work; and
the contractor fails to tell the relevant distributor about the accident, by telephone, immediately after the contractor becomes aware of the accident.
Maximum penalty: 50 penalty units.
An offence against this section is a strict liability offence.
This section does not apply if the defendant had reasonable grounds to believe that the relevant distributor had been told about the accident.
