Electronic Transactions Act 2001

This section applies to a proposal to form a contract made through 1 or more electronic communications if the proposal—

is not addressed to 1 or more particular parties; and

is generally accessible to parties making use of information systems.

The proposal is taken to be an invitation to make offers, unless it clearly shows the intention of the party making the proposal to be bound in case of acceptance.

For subsection (1), a reference to a proposal made through an electronic communication includes a proposal that makes use of an interactive application for the placement of an order through an information system.
