23A Duty to notify existence of contaminated land

(1)

A relevant person in relation to land must notify the authority, in writing, as soon as practicable after becoming aware that the land is contaminated in such a way as to present, or to be likely to present—

(a)

a significant risk of harm to human health; or

(b)

a risk of material environmental harm or serious environmental harm.

(2)

A relevant person must not, without reasonable excuse, contravene subsection (1).

Maximum penalty: 50 penalty units.

(3)

In this section:

relevant person, in relation to land, means—

(a)

the occupier of the land; or

(b)

if the occupier is not the lessee—the lessee; or

(c)

if the land is land under a land sublease and the occupier is not the sublessee—the sublessee.
