Notification of receipt of controlled waste

In force

(1)

A producer commits an offence if the producer—

(a)

moves controlled waste into a jurisdiction of destination; and

(b)

does not receive, within 14 days after the day when the controlled waste was due to arrive at the facility, the information mentioned in the NEPM, schedule B, part 1 for the controlled waste from the agency or facility that gave the consignment authorisation for the controlled waste; and

(c)

does not tell the environment protection authority in writing that the producer has not received the information.

Maximum penalty: 10 penalty units.

(2)

An offence against this section is a strict liability offence.
