Compellability of domestic partners and others in certain criminal proceedings

Section 18 does not apply in a proceeding for an offence against or mentioned in the following provisions:

(a)

an offence against the Crimes Act 1900, parts 2 to 5, that is an offence against a person under 16 years old;

(b)

an offence against the following provisions of the Children and Young People Act 2008:

(i)

section 423 (Offence—contravene care and protection order);

(ii)

section 789 (Offence—contravene employment prohibition notice);

(iii)

section 791 (Offence—contravene employment conditions notice);

(iv)

section 803 (Offence—employment of child or young person under 15 years old in high risk employment);

(v)

section 804 (Offence—contravene condition of permit);

(c)

an offence if the conduct making up the offence is family violence under the Family Violence Act 2016.

Note

This section differs from the Commonwealth Act and NSW Act, s 19.
