50 Secrecy
In this section:
person to whom this section applies means a person who—
is, or has been, engaged in work related to the administration of this Act; or
has obtained access to protected information (directly or indirectly) from a person who is, or has been, engaged in work related to the administration of this Act.
protected information means information about the following people that is disclosed to, or obtained by, a person to whom this section applies in the course of work related to the administration of this Act:
a grant recipient;
a third-party debtor for a grant recipient.
A person to whom this section applies commits an offence if the person—
does something that discloses protected information about someone else; and
is reckless about whether—
the information is protected information about someone else; and
doing the thing would result in the information being disclosed.
Maximum penalty: 50 penalty units, imprisonment for 6 months or both.
This section does not apply if the information is disclosed—
under this Act or another territory law; or
in relation to the exercise of a function, as a person to whom this section applies, under this Act or another territory law; or
in relation to the administration or enforcement of—
a corresponding law; or
a law of the Commonwealth, a State or another Territory for the assessment or imposition of a tax; or
with the consent of the person to whom the information relates or a person acting for that person; or
for the purpose of a legal proceeding; or
as authorised by regulation.
