Protection for authorised officers
53CA Protection for authorised officers
This section applies to an authorised officer who is not a member of the governing board.
Note Members of governing boards are protected from liability under the Financial Management Act 1996, s 90.
The authorised officer is not civilly liable for anything done or omitted to be done honestly and without recklessness—
for the purpose of administering or enforcing a territory gaming law; or
for the purpose of administering or enforcing a gaming law of a reciprocating jurisdiction under division 4.3; or
in the reasonable belief that the act or omission was for a purpose mentioned in paragraph (a) or (b).
Any liability that would, apart from this section, attach to the authorised officer attaches instead to the commission.
