Heritage Act 2004

Advice given by the council to the decision-maker under section 61B (3) must include the following:

an outline of the effect of the proposed tree damaging activity or tree management plan on—

the tree that has heritage significance; or

the place with heritage significance of which the tree forms an important part;

advice about ways of avoiding or minimising the harm of the activity, or risks associated with the plan, for the tree or place.

Advice given by the representative Aboriginal organisation to the decision-maker under section 61B (3) must include the following:

an outline of the effect of the proposed tree damaging activity or tree management plan on—

the Aboriginal cultural tree; or

the Aboriginal place of which the tree forms an important part;

advice about ways of avoiding or minimising the harm of the activity, or risks associated with the plan, for the tree or place.

Without limiting subsection (1) or (2), the advice may recommend conditions that must be complied with.
