Heritage Act 2004

A person or entity proposing to undertake an activity that is likely to diminish the heritage significance of a place or object, or likely to damage an Aboriginal place or Aboriginal object, may make an application to the council for approval of a plan (a statement of heritage effect) that sets out the following:

a description of the place or object, or Aboriginal place or object (the heritage site);

details about the proposed activity, including the reason for the activity and the extent and duration of the activity;

the likely effect of the proposed activity on the heritage site, including the effects that may diminish the heritage significance of, or damage, the heritage site;

the measures the applicant will adopt during the activity to reduce the risk of diminishing the heritage significance of, or damage to, the heritage site;

whether other reasonably practicable ways of carrying out the activity at the heritage site are available;

any other matter prescribed by regulation.

An application must—

be in writing; and

be given to the council; and

include the following information:

the applicant’s name and address;

the location or address of the heritage site;

any other matter prescribed by regulation; and

attach the applicant’s statement of heritage effect.

Section 117 deals with giving documents to the council.
