85 Power to require name and address
An authorised person may require a person to state the person’s name and home address if the authorised person suspects, on reasonable grounds, that the person is committing, is about to commit, or has committed, an offence against this Act.
A reference to an Act includes a reference to the statutory instruments made or in force under the Act, including regulations (see Legislation Act, s 104).
If an authorised person makes a requirement of a person under subsection (1), the authorised person must—
tell the person the reasons for the requirement; and
as soon as practicable, record the reasons.
A person commits an offence if the person contravenes a requirement under subsection (1).
Maximum penalty: 10 penalty units.
However, a person is not required to comply with a requirement under subsection (1) if, when asked by the person, the authorised person does not produce the authorised person’s identity card for inspection by the person.
An offence against subsection (3) is a strict liability offence.
