40 Definitions for div 3.6
In this division:
Commonwealth administrative review tribunal means the Administrative Review Tribunal established under the Administrative Review Tribunal Act 2024 (Cwlth), section 8.
decision—see the Administrative Review Tribunal Act 2024 (Cwlth), section 4.
eligible person, in relation to a decision of the NHMRC licensing committee, means:
in relation to a decision under section 30 not to issue a licence—the applicant for the licence; or
in relation to a decision about the period throughout which the licence is to be in force under section 32—the licence holder; or
in relation to a decision to state a licence condition under section 33 (3)—the licence holder; or
in relation to a decision to modify guidelines under section 33 (7) in relation to a licence—the licence holder; or
in relation to a decision to vary or refuse to vary a licence under section 34—the licence holder; or
in relation to a decision to suspend or revoke a licence under section 35—the person who was the licence holder immediately before the suspension or revocation.
