53A Referral of discrimination complaints other than commission-initiated discrimination matters
This section applies if—
either—
a complainant is given a discrimination referral statement under section 45 (3) (d); or
a statement under section 82 (1) is included in a final report in relation to a complaint; and
within 60 days after the statement is given, the complainant requires the commission to refer the complaint to the ACAT.
The commission must—
refer the complaint to the ACAT; and
tell the complainant and the respondent in writing about the referral.
The commission must also close the complaint (see s 78 (2) (d)).
In this section:
complaint does not include a commission-initiated discrimination matter.
