53R Occupancy dispute complaints—referral
This section applies if—
either—
a complainant is given an occupancy dispute referral statement under section 45 (3) (f) (Commission’s obligation to be prompt and efficient); or
a statement under section 82B (1) (Closing occupancy dispute complaints) is included in a final report in relation to a complaint; and
within 60 days after the statement is given, the complainant requires the commission to refer the complaint to the ACAT.
The commission must—
refer the complaint to the ACAT; and
tell the complainant and the respondent, in writing, about the referral.
The commission must also close the complaint (see s 78 (2) (d)).
