88B Occupancy dispute referral statements
An occupancy dispute referral statement is a statement in a notice in relation to an occupancy dispute complaint to the effect that—
the commission has closed the complaint; and
the complainant may ask the commission to refer the complaint to the ACAT within 60 days after the day the notice is given to the complainant; and
after the 60-day period, the complainant may apply to the ACAT under section 53S (Occupancy dispute complaints—late application in exceptional circumstances) for the complaint to be heard.
The commission must refer the complaint to the ACAT if the complainant asks it to refer the complaint within the 60-day period (see s 53R).
If the commission closed the complaint because it was satisfied of one of the reasons mentioned in s 78 (2) (c), the complaint may be heard by the ACAT only with the leave of the ACAT (see s 53SAA).
