28 Failure to notify proposals and agreements
If a person fails to notify the commission under section 25 of a proposal for an access agreement, or under section 26 of entering into an access agreement, the commission may request the person to provide the commission with written reasons for that failure.
The commission must give a report to the Minister about a failure to notify a proposal for an access agreement or the entering into of an access agreement, and include in the report any reasons provided under subsection (1).
A failure to comply with section 25 or section 26, or a failure by the commission to give advice under section 25, does not affect the validity of the agreement.
