95 Protection of assessors from liability

(1)

An assessor is not civilly liable for conduct engaged in honestly and without recklessness—

(a)

in the exercise of a function under this Act; or

(b)

in the reasonable belief that the conduct was in the exercise of a function under this Act.

(2)

An assessor is, in any legal proceeding, competent but not compellable to give evidence or produce documents in relation to any matter in which the assessor was involved in the course of exercising the assessor’s functions.

(3)

Any civil liability that would, apart from this section, attach to the assessor attaches instead to the Territory.

(4)

In this section:

assessor means the following:

(a)

a claims assessor;

(b)

a principal claims assessor;

(c)

an eligibility assessor;

(d)

a treatment and care assessor.
