Offence—fail to comply with removal direction

In force

(1)

A person commits an offence if the person—

(a)

is subject to a removal direction; and

(b)

fails to comply with the direction.

(2)

Subsection (1) does not apply if the person has a reasonable excuse for failing to comply with the direction.

Maximum penalty: 20 penalty units.

Note

The defendant has an evidential burden in relation to the matters mentioned in s (2) (see Criminal Code, s 58).

(3)

An offence against this section is a strict liability offence.
