42 Definitions—div 2.2.2

In this division:

found guilty, of an offence—

(a)

includes having the offence taken into account under the Crimes (Sentencing) Act 2005, section 57 (Outstanding additional offences taken into account in sentencing); but

(b)

does not include having an order made for the offence under the Crimes (Sentencing) Act 2005, section 17 (Non-conviction orders—general).

level, for a concentration of alcohol in blood or breath—see the Road Transport (Alcohol and Drugs) Act 1977, dictionary.

outstanding, for a charge—see the Bail Act 1992, section 9D (6).
