68 Insurer may change decision about accepting or rejecting liability

(1)

A decision by a relevant insurer to accept liability for defined benefits does not prevent the insurer from making a later decision to reject the liability.

Note Section 65 (3) applies to a later decision to reject liability.

(2)

However, if a relevant insurer later rejects liability, the insurer may only recover amounts paid to the applicant under this part from a relevant insurer who later accepts liability for the defined benefits.

(3)

A decision by a relevant insurer to reject liability for defined benefits does not prevent the insurer from making a later decision to accept the liability.
