149 Delegation by commissioner
The commissioner may—
delegate to a public employee or another person a function given to the commissioner under this Act or any other law applying in the ACT; or
subdelegate to a public employee or another person a function delegated to the commissioner under a law other than this Act.
For the making of delegations and the exercise of a delegated function, see the Legislation Act, pt 19.4.
A reference to an Act includes a reference to the statutory instruments made or in force under the Act, including any regulation (see Legislation Act, s 104).
However, the commissioner must not delegate or subdelegate a function to a person who is not a public employee without first being satisfied that the function needs to be undertaken by a person who is not a public employee.
