If the commission has suspended a licence until a condition has been met, the commission may end the suspension at any time, even though the condition has not been met.

Note Subsections (1) and (2) apply subject to s (3) and s (4).

If the commission has suspended a licence for a stated period, the commission may end the suspension at any time before the end of the period.

Note Under pt 10 (Notification and review of decisions), a decision not to end a licence suspension may, on application, be reconsidered by the commission and reviewed by the ACAT.

However, the commission may end a suspension under subsection (1) or (2) only if the commission is satisfied that a special reason justifies ending it.

This section does not apply to a suspension under section 67 (5) (Power to hold inquiry).
