6E Certain people given right of occupation not tenants

(1)

A residential tenancy agreement does not include an agreement for the right to occupy premises if the person given the right of occupation is—

(a)

a party to an agreement entered into honestly for the sale or purchase of the premises; or

(b)

a person prescribed by regulation.

(2)

This section is subject to the following sections:

 section 6B (Residential tenancy agreement if agreement written and says it is residential tenancy agreement)

 section 6C (Residential tenancy agreement if agreement part of employment).
