49 Publication of published proceedings, reports and comments protected
The proceedings of a hearing before a commission are taken to be proceedings of public concern for the Civil Law (Wrongs) Act 2002, section 139 (Defences of fair report of proceedings of public concern).
Subsection (1) does not apply in relation to the publication of a report of proceedings, or a part of proceedings, if a direction given under section 28 (3) restricts publication of the proceedings or part of them and the publication of the report contravenes the direction.
A report of a commission that has been made public by the Chief Minister is taken to be a public document for the Civil Law (Wrongs) Act 2002, section 138 (Defence for publication of public documents).
