This section applies in relation to a person (the 3rd party) if the commissioner for fair trading is satisfied that the 3rd party has an association or connection with an applicant for a licence, or for variation of a licence, that is relevant to the application.

The commissioner for fair trading may, by written notice to the 3rd party, require the 3rd party to do 1 or more of the following:

provide, in accordance with directions in the notice, stated information, verified as required by the notice, that is relevant to the consideration of the application;

produce, in accordance with directions in the notice, stated records relevant to the consideration of the application and allow examination of the records, the taking of extracts from them and the making of copies of them;

authorise a person described in the notice to comply with a stated requirement of the kind mentioned in paragraph (a) or (b);

give the commissioner for fair trading the authorities and consents the commissioner asks for to allow the commissioner to obtain information (including financial and other confidential information) from other people about the applicant and the applicant’s associates or relatives.

If the commissioner makes a requirement, the commissioner need not decide the application until the requirement is complied with.
